Pools
A building permit is required for any fence enclosure that surrounds an outdoor pool. Please apply for a permit through our CloudPermit system on our Apply for a Permit page.
A privately owned outdoor pool is any body of water located outdoors on privately owned property, contained in whole by artificial means, in which the depth of water at any point can exceed 0.6 metres (24 inches).
To ensure the safety of the public, a pool cannot be constructed and filled with water without a fence installed as per Town of Midland Bylaw 99-71.
A detailed site plan must include:
- Lot lines, lot dimensions and lot area
- All existing and proposed buildings on the lot
- The proposed pool dimensions and location
- Proposed pool setbacks from the property lines
- The location of pool equipment (heat pump and filter) and distances from lot lines to the equipment
- The location, height, and material (wrought iron, wood and/or chain link) of proposed fence
- The location, height and type (self-closing or latching) of lockable gates
- ***For inground pools a lot grading plan will also be required***
Exceptions to the Bylaw:
- Hot tubs with locking lids
- Pools under 24 inches
If placing a hot tub on an existing deck, a permit with engineered drawings will be required for the deck.
